中新网10月31日电 据“长沙中院”微信公众号消息，10月31日，长沙市中级人民法院依法对刘翔峰案一审公开宣判。对被告人刘翔峰以故意伤害罪判处有期徒刑十年；以受贿罪判处有期徒刑三年，并处罚金二十万元；以非国家工作人员受贿罪判处有期徒刑三年，并处罚金十二万元；以职务侵占罪判处有期徒刑三年，并处罚金十万元；数罪并罚，决定执行有期徒刑十七年，并处罚金四十二万元。同时，对同案被告人罗原灯以故意伤害罪、非国家工作人员受贿罪，数罪并罚，决定执行有期徒刑七年，并处罚金十万元。对上述被告人犯罪所得予以追缴，上缴国库。图自“长沙中院”微信公众号法院经审理查明：被告人刘翔峰在湘雅二医院工作期间，为牟取额外手术费用，单独或伙同被告人罗原灯夸大患者病情、虚构患者病征，给6名不具备相关手术指征的患者实施手术，致5人重伤、九级伤残，1人轻伤；利用职务便利，在引进医药产品上为他人提供帮助，收受贿赂66万余元。刘翔峰利用主持或参与手术的工作便利，收受医药产品销售人员回扣358万余元，非法侵占价值193万余元的手术耗材。上述手术耗材已被依法收缴。法院审理认为，被告人刘翔峰犯罪情节严重，社会影响极其恶劣，应当依法从严惩处；同时，刘翔峰有自首、坦白、退缴违法所得等法定、酌定从轻情节，遂依法作出上述判决。案件审判过程中，法庭依法保障了被告人的诉讼权利。部分人大代表、政协委员及当事人亲属等旁听了案件宣判。
